Terms and conditions
Please carefully read the General Conditions before making a reservation. Conditions are valid from 1/10/2008 to 31/12/2009 and replace all previously published conditions.
Reservations
After verifying the availability of an accommodation, the renter can then confirm the reservation. TRIMODIUM.COM will then send you a rental contract and bill you for the reservation amount. The contract is to be returned to us, signed and dated, accompanied by proof of payment of the reservation.
FEE: The reservation fee is 40% of the total amount of the reservation, and is to be paid within 3 days from the time the reservation is made.
IMOPORTANT: the renter needs to send us either by fax or e-mail a copy of the transaction, a bank transfer is the preferred method of payment.
The reservation fee must be paid at the time of the reservation. Reservation fees are as follows: 40% of the total accommodation rental 6 weeks prior to the first day of the rental, 60% of the total accommodation rental if the reservation is less than 6 weeks prior to the first day of the rental, or 100% of the accommodation rental if the reservation is less than 30 days prior to the first day of the rental.
We cannot accommodate reservations that are not accompanied by a proof of payment. If the reservation fee is not paid within the timeframe indicated (3 days), TRIMODUM has the right to cancel the reservation.
Confirmation: The reservation is confirmed once the rental fee of 40% has been paid and the rental contract is signed and returned to us before the expiration date stated on the rental contract. The balance of the accommodation rental is due 6 weeks prior to the commencement of the rental, except in special circumstances with the prior agreement of TRIMODUM.com, otherwise, without prior notification,TRIMODUM.com in the event that the balance is not paid 6 weeks prior to the rental period reserves the right to terminate a contract without prior notification and without the renter’s claim to a refund or any compensation.
Once the full amount of the rental has been paid, TRIMODUM.com will send to the renter a receipt for the reservation by either e-mail, fax, or letter mail as to the preference of the renter, along with all the information pertinent to the rental (location, arrival times, contact details, etc.).
Methods of Payment
Payments can be made by bank transfer.
IMPORTANT: Client should send by fax or e-mail a copy of transaction, which normally is a bank transfer.
Prices
Prices listed on our web page are for 1 week durations, and are expressed in EUROS.
Prices are in function of the contractual conditions established on the date of the signing of the contract. We reserve the right to modify the rates without prior notice. It is solely the rental contract which confirms the reservation, which attests to the contractual agreement.
Our rental fee includes utilities such as water, electricity, and gas, and in general the maintenance of the pool and garden.
Bed sheets are supplied, but in some cases there is a supplemental charge. Final cleaning is not always included in the rental price, and can change in function to the type of rental. Heating and Air-conditioning are not generally included in the rental price.
There is a €30 rental contract fee.
Any dispute relating to the rental price may not be considered after the signing of the contract.
It is the renter’s responsibility to determine that the rental price is acceptable before signing the contract.
The rental price includes taxes and honorary fees.
Damage deposit
A damage deposit will be required by the property owner. The amount will vary depending on the type of property rented. The damage deposit can be taken either in cash or as a credit card impression upon your receiving the keys for the rental upon your arrival. The damage deposit is to cover possible damages incurred by the renter to the rental property or its contents during your stay. The damage deposit will be returned the day of your departure, or 10 days after, depending on the rental agreement, if no damage has been caused to the property rented as determined by the property owner or its representative.
Tirmodum.com does not intervene in the payment of damage deposits and as such has no responsibility in this matter.
Pets
Animals are not generally accepted in most of the rental properties. If you wish to bring a pet we will prior notify the property owner to determine if this is acceptable before making the reservation. Omitting to prior notification to the property owner of the presence of a pet can result in the immediate cancelling of the reservation without refund.
In the rentals that permit pets, a rental supplement may be charged, and the damage deposit may be increased.
For your information: The health department requires a vaccination certificate for rabies, and a good health certificate at least 8 days prior to your arrival.
Number of Lodgers
The number of people specified in the rental contract cannot be augmented, and the addition of supplementary beds, tents, mobile homes, trailers, etc. is not authorized.
Check-in and Check-out
Check-in is on Saturday between 16.00 and 20.00h, with the exceptions of the Villas of Tamariu where check-in is on Friday between 16.00 and 20.00h. Check-out is on Saturday (Friday for the Villas of Tamariu), no later than 10.00h.
If you can’t arrive at the specified time, please contact with as much advance notice as possible the reception office. The phone number is indicated on the reservation confirmation.
Cancellations
Cancellations must be made to Trimodum.com by certified mail with return receipt. The cancellation will be effective from the day of the receipt of the cancellation in our office, with the following costs:
- between 90 and 60 days to the first day of the rental: 30% of the rental price.
- between 59 and 45 days to the first day of the rental: 50% of the rental price.
- less than 44 days before the first day of the rental: 100% of the rental price.
Trimodum.com does not provide cancellation insurance. We advise our clients to have cancellation insurance.
All stays that are cut short or interrupted, for whatever causes that might be, are not eligible for a refund.
Descriptions
All information provided is given in good faith based on the information provided by the property owners, their representatives, and undertaken as their responsibility.
Upon arrival to the accommodation, verify that the property in its entirety corresponds to the description given. Trimodum.com cannot be liable for discrepancies the property owner or its representatives might have caused (omitting details, dissimulation, hidden defects, etc.). In as much, the role of trimodum.com is limited to being an intermediary between the renter and property owner, and is not responsible for modifications to the rental property, its natural setting, or its availability, and any changes that have not been notified by the owner before booking date or between the booking date and the entry into the accommodation.
Pool
Pools are usable as a general rule from the 1st of June until the 30th of September. Pools cannot be drained. The renter must not manipulate the pool maintenance equipment.
During the off season (from October to May) pools might be covered or emptied.
The renter is solely responsible for children’s safety around the pool if is not fenced in or protected.
Rental Property Provisions
The property owner or local representative is totally responsible for the rental properties good condition and standing. It is the property owner or local representative that will receive the renter upon arrival and is responsible for all subsequent formalities (getting keys, damage deposit, receiving renters,etc.)
All accommodations are delivered in perfect condition and in perfect standing.
Any claim or complaint in regard to the condition of the accommodation must be made with 24 hours of your arrival, or it will not be valid.
- Renters should treat the properties “as if it was theirs”, and maintain it in accordance with this idea. Any repairs that are caused by negligence or poor care of installations will be the responsibility of the renter.
- Renter and their family are obliged to respect the idea peace and quiet and not to disturb the neighbors.
_ All the furniture and other contents of the accommodation must be returned to their rightful place.
Insurance claims
Trimodum.com is not liable for any claims made against it.
Furthermore, renters should have travel insurance to cover the duration of their stay so as to be protected against the unlikely possibility of theft, damage to the property, or 3rd party negligence.
There is no guarantee or coverage against theft, loss, or any damage that might occur whatsoever to personal effects, luggage, objects, furniture, valuables, vehicles, etc.
The parties agree that Trimodum.com will never be responsible for any claims made against it, and as such it is the renter who is responsible for having adequate insurance to cover any accident, loss, or injury.
Litigation
For any dispute, the parties acknowledge the exclusive jurisdiction of the courts of Barcelona. The signing of the reservation contract, and the reservation confirmation imply the understanding of the general conditions of hire and their acceptance without reservations or exceptions.
